PURPOSE AND SCOPE

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Evakit and any customer making a purchase on the evakit.com website. Evakit designs, assembles, and markets compact, waterproof emergency evacuation kits, intended to ensure a safe evacuation during the first 72 hours of a crisis. Any order implies the unreserved acceptance of these GTC, which take precedence over any other document.

3. PRODUcTS

3.1 Description

The products offered are emergency evacuation kits that include various survival and first-aid items, assembled in France. The descriptions and characteristics of the products are presented on the website with the greatest possible accuracy. The kits are available in “complete” versions for one person and two people, or “a la carte.”

3.2 Origin and manufacturing

Evakit kits are designed, assembled, and quality-controlled in France. The components and bags are sourced internationally, mainly from France, Spain, Norway, and China. Each item is individually inspected before assembly.

3.3 Compliance and Certifications

All kits have CE certification and comply with current European regulations.

3.4 Shelf Life and Expiration

Certain components of the kits (chemical light sticks, food rations, water) have a shelf life of 5 years. An email notification system informs customers when replacement of expiring items is necessary.

4. Orders

4.1 Order Process

The customer selects the products they wish to order, adds them to their cart, and then validates the cart. They then enter their delivery and billing details, choose the delivery and payment method, and confirm their order after reviewing and accepting these GTC.

4.2 Order Confirmation

An order confirmation is sent by email after payment validation. This confirmation summarizes the order details, total amount, and delivery information.

4.3 Modification and Cancellation

Any request for modification or cancellation must be sent as soon as possible to info(at)evakit.com. Once the order has been shipped, no modification is possible.

PRICING

5.1 Displayed Prices

Prices are indicated in euros (€) including all taxes (TTC), which includes the VAT applicable on the day of the order. They do not include delivery fees, which are billed separately.

5.2 Price Changes

Evakit reserves the right to change its prices at any time. Products are billed at the rate in effect at the time the order is validated.

5.3 Promotions

Promotional offers are valid while supplies last and for the duration indicated. They are not combinable unless otherwise stated.

PAYMENT

6.1 Payment Methods

Payment can be made online by credit card (Visa, Mastercard, American Express) or any other payment method offered on the site. All payments are secured via our partners, Stripe and PayPal.

6.2 Security

Transactions are secured by an SSL encryption system. Evakit does not store any banking data.

6.3 Payment Validation

The order is only validated after payment confirmation by the bank. In case of refusal, the order is automatically canceled.

DELIVERY

7.1 Delivery Zone

Evakit ships to all countries in the European Union and potentially to other geographical areas depending on availability. However, some areas, including within the European Union, may be implemented at different times.

7.2 Delivery Times

Delivery times are given as an estimate at the time of the order. Evakit strives to meet these deadlines but cannot be held responsible for delays caused by carriers or circumstances beyond its control.

7.3 Delivery Fees

Delivery fees are calculated based on weight, volume, and destination. They are indicated before the order is validated.

7.4 Receipt of the Order

The customer must check the condition of the package in the presence of the delivery person. In case of apparent damage, the customer must refuse the package or make precise and detailed reservations on the delivery slip. Any anomaly must be reported to info(at)evakit.com within 48 hours of receipt.

RIGHT OF WITHDRAWAL

8.1 Withdrawal Period

In accordance with Article L221-18 of the Consumer Code, the customer has a period of 14 days from the receipt of their order to exercise their right of withdrawal without having to provide reasons or pay penalties.

8.2 Exercising the Right

To exercise this right, the customer must notify their decision by email to info(at)evakit.com or by registered mail with acknowledgment of receipt.

8.3 Return of Products

Products must be returned in their original condition, complete (packaging, accessories, instructions), and unused. Return costs are the responsibility of the customer, including for international returns.

8.4 Refund

The refund will be issued within a maximum of 14 days from the receipt of the returned product. The refund will be made using the same payment method used for the order.

WARRANTIES

9.1 Legal Warranty of Conformity

In accordance with Articles L217-4 and following of the Consumer Code, all products benefit from the 2-year legal warranty of conformity from the delivery of the goods. The customer can choose between the repair or replacement of the goods, subject to the cost conditions provided by law.

9.2 Warranty Against Hidden Defects

The customer also benefits from the legal warranty against hidden defects provided for in Articles 1641 and following of the Civil Code.

9.3 Implementation

To assert their rights, the customer must contact info(at)evakit.com and describe the non-conformity or defect found.

LIABILITY

10.1 Use of Products

Evakit kits are designed for emergency and evacuation situations. The customer is responsible for the appropriate use of the products in accordance with the instructions provided. Evakit cannot be held responsible for improper use, use that is not in accordance with instructions, or damages resulting from circumstances beyond its control.

10.2 Limitation of Liability

Evakit’s liability is limited to the amount of the order. Evakit cannot be held responsible for indirect damages, loss of profits, or commercial harm.

10.3 Force majeure

Evakit will not be held responsible for any delay or non-performance in the event of force majeure as defined by French jurisprudence.

INTELLECTUAL PROPERTY

All elements of the evakit.com website (texts, images, graphics, logo, icons, sounds, software) are the exclusive property of Evakit or its partners. Any reproduction, representation, modification, publication, or total or partial adaptation is strictly forbidden without prior written authorization.

PERSONAL DATA

12.1 Collection and Processing

The personal data collected are necessary for processing orders and managing customer relationships. They are subject to computer processing in compliance with the GDPR.

12.2 Customer Rights

In accordance with the GDPR, the customer has a right of access, rectification, erasure, restriction, portability, and objection concerning their personal data. These rights can be exercised by writing to info(at)evakit.com.

12.3 Retention

Data are kept for the period necessary for the purposes for which they are collected, in accordance with current regulations.

14. MeDIATION

In accordance with Article L612-1 of the Consumer Code, the customer has the right to use a consumer mediator free of charge for the amicable resolution of a dispute with Evakit.

APPLICABLE LAW AND JURISDICTION

These GTC are subject to French law. In the event of a dispute, and after an attempt to find an amicable solution, French courts will have exclusive jurisdiction. For consumer customers, the competent court will be that of Evakit’s registered office, which is Bayonne, France.

MISCELLANEOUS PROVISIONS

16.1 Entire Agreement

These GTC constitute the entire agreement between the parties and replace all prior agreements.

16.2 Partial Invalidity

If one or more provisions of these GTC are held to be invalid or declared as such, the other provisions shall retain their full force and effect.

16.3 Modification

Evakit reserves the right to modify these GTC at any time. The applicable GTC are those in effect on the date of the order.

ACCEPTANCE

Placing an order implies full and complete acceptance of these General Terms and Conditions of Sale.
